App Terms of Service

These Terms of Service ("Terms") form the end user license agreement ("EULA") that governs your use of the mobile applications published by Forge Syntax under our developer accounts on the Apple App Store and Google Play. By downloading or using an App, you agree to these Terms. If you do not agree, do not use the App.

Your use of an App is also subject to the terms and policies of the app store from which you obtained it, including the Apple Media Services Terms and Conditions or the Google Play Terms of Service, as applicable. If these Terms conflict with the usage rules of those app store terms, the app store terms prevail to the extent of the conflict.

You and we acknowledge that these Terms are concluded between you and Forge Syntax only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Forge Syntax, not Apple or Google, is solely responsible for the Apps and their content.

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Apps on devices you own or control, for your own lawful use, in accordance with these Terms and the applicable app store rules.

For Apps obtained from the Apple App Store, this license is limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

When using our Apps, you agree to:

• Use the Apps only for lawful purposes and in compliance with all applicable laws
• Not reverse engineer, decompile, modify, or attempt to extract the source code of the Apps, except where such restriction is prohibited by law
• Not interfere with, disrupt, or attempt to gain unauthorized access to any systems or networks used by the Apps
• Not use the Apps to transmit unlawful, harmful, or infringing content
• Not use the Apps for any commercial purpose without our prior written consent

Our Apps may include features related to sleep tracking, dream journaling, and wellness monitoring. These Apps are not medical devices and are not intended to diagnose, treat, cure, or prevent any health condition, sleep disorder, or medical issue.

• The information and data provided by our Apps are for general informational and personal tracking purposes only.
• Sleep quality scores, insights, and suggestions are not a substitute for professional medical advice, diagnosis, or treatment.
• If you have concerns about your health or sleep, please consult a qualified healthcare professional.
• Do not disregard or delay seeking medical advice based on anything you read or record in our Apps.

Our Apps are designed with a privacy-first approach. Your App data — including scanned images and documents, sleep records, dream notes, and audio recordings — is stored locally on your device. We do not collect, transmit, or have access to this data on our servers.

Some Apps offer in-app purchases, including premium upgrades and subscriptions. All purchases are processed and billed by the Apple App Store or Google Play under their terms. We do not handle your payment information directly.

• Purchases: Linked to your Apple or Google account. You can restore eligible purchases on your devices using the store's standard restore feature.
• Subscriptions: Auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions through your app store account settings at any time. Deleting the App does not cancel a subscription.
• Pricing: All prices are displayed in local currency and may vary by region as determined by the app store platform.

Because in-app purchases are processed by the app stores, all billing, refund, and cancellation requests are handled by Apple or Google in accordance with their respective policies. Any refund eligibility is determined solely by the applicable app store.

Some Apps are supported by advertising delivered through Google AdMob and AdMob mediation, which may include third-party ad networks such as Unity Ads and others. These providers operate under their own terms and privacy policies.

Where offered, you can remove all advertising by purchasing the premium (ad-free) version or subscription within the App.

Forge Syntax is solely responsible for providing any maintenance and support services for the Apps, as described in these Terms or as required under applicable law. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the Apps. The Apps may rely on third-party services and software, including app store platforms, advertising networks, and operating system features. We are not responsible for the content, policies, or practices of these third parties, and your use of their services may be subject to their own terms.

You must comply with all applicable third-party terms of agreement when using the Apps. For example, you must not be in violation of your wireless carrier or data service agreement when using an App that uses a network connection.

The Apps, including their software, design, branding, and content, are owned by or licensed to Forge Syntax and are protected by applicable intellectual property laws. Except for the limited license granted above, no rights are transferred to you.

In the event of any third-party claim that an App, or your possession and use of an App, infringes that third party's intellectual property rights, Forge Syntax, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

To the extent not effectively disclaimed, Forge Syntax is solely responsible for any product warranties, whether express or implied by law. Subject to that, the Apps are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, and we do not warrant that the Apps will be uninterrupted, error-free, secure, or compatible with every device or operating system version.

For Apps obtained from the Apple App Store: in the event of any failure of an App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for that App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Forge Syntax.

Forge Syntax, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Apps or your possession and/or use of the Apps, including but not limited to:

• Product liability claims;
• Any claim that an App fails to conform to any applicable legal or regulatory requirement; and
• Claims arising under consumer protection, privacy, or similar legislation, including in connection with an App's use of the HealthKit and HomeKit frameworks.

To the maximum extent permitted by law, Forge Syntax is not liable for any indirect, incidental, special, or consequential damages, or any loss of data, arising from your use of or inability to use the Apps. Nothing in these Terms limits our liability to you beyond what is permitted by applicable law.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

We may update these Terms from time to time. When we do, we will revise the effective date above. Continued use of an App after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, please discontinue use of the App.
